Partner Terms and Condition

Definitions:
We, our = The game provider (US)
Partner = The partner (YOU)
Player(s) = The person you introduce, can be players in the game or other partners

1). Tagging Players
When players introduced by you registers or signs up for our game, the game will automatically tag this player for life as introduced by you via cookie (So long as the person does not format/switch PC or delete/remove the cookie). "Active players" that is mentioned in this partner program is defined as the unique human individual which is active in the game. This means a single unique real person in our games; and has signed up for longer than (7) days; and has logged in the past few days.

2). Length of time
We will continue to pay you for active players* with no time limit. This means if an active player* referred by you continues to play for 10 years, we will continue to pay you for the next 10 years for this player.

3). How report is generated
The system will automatically generate report based on your active players* each day.

4). Payment calculation
We will pay you based on the average active players* per month. For example, December there is 31 days, and you have so we will take a total of all your active players* counted on the daily basis in section 3). and divide it by 31 days. This will give us an average active player per day.

5). Termination
Once your in-game account is expired due to inactivity (30 days with out logging in), the system automatically removes your account information, therefore erasing all your partner information. We will not be held liable if you forget to login, to keep your account active.

6). Payment
Please refer to the Partner > FAQ > Getting Paid / Withdrawing section.
We are always trying to improve our banking facility, therefore we may reduce the time frame for withdrawing funds as well as the rates as time goes by. This factor is out of our hands and fall upon the banks.

7). Payout Rate
The current estimated payout rate will be listed in the Partner > Statistic page. Once the payout rate has been confirmed, (usually it should be around there) it will be updated in your `Past Month` report located in the same page. The factors we will use to determine this factor will be and not limited to; total players donating/subscribing.

8). Cheating & fraud
We can choose not to pay any amount owing to you and can reverse all those which have already been paid to you; and to immediately terminate your partner program and your in-game account if any fraud or cheating is found to fraudulently or artificially increase the active players* by and not limited to; hacking, using of robots or software, any unlawful methods, flooding, spam, abuse and signing up multiple fake accounts. If any cheating or fraud were to be discovered, depending on the severity the case, we can have the right to demand back any payment already made to you or a filing criminal charges against you; or a legal suit; or all of the actions.

9). Partner responsibility
Our partner shall be held liable for his/her actions and we will not be liable for any action taken by any of our partners (you). If any complains were to be filed against any partner, we shall conduct a full investigation in a reasonable time frame. All complains regarding any abuse/spam/flood/hack/cheating by our partners should be sent to abuse@gamestotal.com with the title `Partner abuse` with as much detail as possible. We, depending on the severity of the case can exercise the following:- 1st time - warning
2nd time - 2nd warning
3rd time - reset all amount outstanding to partner

10). Disclaimer
Both parties understand and acknowledge that we and the partner (including any content, code, or any other elements contained therein) may have errors and may produce unexpected results. As such, excluding as expressly set forth herein, we and the partner are provided "as is" and neither party offers any warranties, either express or implied, regarding we and the partner. Both parties expressly disclaim any implied warranties of merchantability, fitness for a particular purpose, or that we and the partner services are error-free, that any errors will be corrected, that we and the partner are non-infringing, or that the we or the partner will be free of viruses or other harmful components. Except for the indemnification obligations set forth herein, under no circumstances and under no legal theory, whether tort (including negligence), contract, or otherwise, shall either party be liable to one another or any other third party for any indirect, special, incidental, or consequential losses, costs, expenses or damages of any character including, without limitation, damages for loss of goodwill, work stoppage, tortious conduct, computer failure or malfunction, or any and all other commercial damages or losses (including but not limited to, loss of business, profits or data) relating to, or arising from, the use of or inability to use the partner program provided by us, even if such party shall has been informed of the possibility of such damages.

11). Force Majeure
We deserves the right to delay, adjust, or suspend the payout rate, withdrawal of funds and this partner program if there is any events which disallows us from fulfilling our duties, for example but not limited to; any act of God, fire, natural disaster, accident, act of government, requirement of law/court, death.

12). Future Updates
We deserves the right to amend this agreement in good faith for the benefit of both the partner and us.
